1. Objective

This policy regulates intellectual property, image rights and the use of content within the Togere platform.

Its purpose is:

• Protect the rights of creators.
• Protect the rights of the people who appear on the covers.
• Facilitate the resolution of conflicts related to content.
• Guarantee compliance with applicable legislation.

2. Ownership of the content

Users retain ownership of the content they publish on Togere.

This includes, but is not limited to:

• Photographs.
• Texts.
• Comments.
• Descriptions.
• Covers.
• Original creative elements.

The publication of content on Togere does not imply the transfer of intellectual property to the Digital Resource Association.

3. License granted to Togere

In order to provide the service, the user grants Togere a license:

• World Cup.
• Non-exclusive.
• Free.
• Revocable.
• Limited to the operation of the platform.

This license allows Togere to:

• Store the content.
• Show it within the platform.
• Distribute it to other users.
• Generate thumbnails.
• Adapt it technically to different devices and formats.
• Incorporate it into Togere's own functions.

The license will end when the content is deleted, except when there are legal obligations or technical copies necessary for the operation and security of the service.

4. User guarantees

By posting content on Togere, the user declares that:

• You are the owner of the necessary rights over said content.
• You are authorized to use it.
• Its publication does not violate the rights of third parties.
• You have the legally necessary authorizations when identifiable people appear.

The user assumes responsibility for any claim related to the content they publish.

5. Image rights

Users must respect the image rights of other people.

It is not allowed to publish content that includes third parties when:

• The applicable legislation is violated.
• Is used for deceptive purposes.
• Is used to harass or harm a person.
• It is published without the legally required authorizations.

The responsibility for obtaining the necessary permissions lies with the user who makes the publication.

6. Minor content

The publication of images of minors must comply with applicable legislation.

Togere may restrict, limit or eliminate covers that:

• Put minors at risk.
• They violate the rights of minors.
• They lack the legally necessary authorizations.

The protection of minors will have priority in moderation decisions.

7. Content generated by artificial intelligence [[S9]] Togere prioritizes authentic content.

Togere prioritizes authentic content.

It is not permitted to use content generated by artificial intelligence to:

• Impersonate real people.
• Create misleading representations.
• Violate image rights.
• Mislead about the authenticity of the content.

The platform may limit, label or eliminate content when there are reasonable indications of improper use of artificial intelligence.

8. Trademarks and distinctive signs

Users must respect the rights of third parties related to:

• Registered trademarks.
• Trade names.
• Logos.
• Protected designs.

The incidental presence of marks in an image does not necessarily imply infringement.

However, Togere may act when there are justified claims or reasonable indications of violation.

9. Complaints for infringement of rights

Rights holders may report possible infringements by:

The request must include, at least:

• Identification of the claimant.
• Description of the rights affected.
• Identification of the reported content.
• Sufficient information to evaluate the claim.
• Declaration of good faith regarding the accuracy of the information provided.

10. Review procedure

When Togere receives a reasonably substantiated claim, it may:

• Request additional information.
• Temporarily limit the visibility of content.
• Remove the content.
• Request clarification from the affected user.
• Take action on the account when necessary.

Decisions may be reviewed later if new evidence appears.

11. Fraudulent claims

The abusive use of complaint procedures may give rise to:

• Rejection of future claims.
• Account limitations.
• Other measures permitted by applicable regulations.

12. Removed content

The removal of content for reasons of intellectual property or image rights does not necessarily imply the immediate deletion of all associated records.

Certain information may be retained for the time necessary to:

• Resolve conflicts.
• Comply with legal obligations.
• Protect the security of the platform.

13. Limitation of liability

Togere acts as a hosting and distribution platform for user-generated content.

The Digital Resource Association does not carry out an individual prior review of all the covers.

The main responsibility for the published content corresponds to the user who generates it.

However, Togere may intervene when it has actual knowledge of possible violations or when there are reasonable indications of non-compliance.

14. Collaboration and amicable resolution

Whenever possible, Togere will endeavor to facilitate the amicable resolution of conflicts related to intellectual property rights or image rights.

15. Modifications to this policy

The Digital Resource Association may update this policy to adapt it to:

• Legal changes.

• Evolution of the platform.

Updated versions will be available in the app and on the official website.
